The Incident: On Saturday afternoon Oct. 15, 2011 three students from FMG Gaudineer Middle School in Springfield; Student 1 from the Rulers community, Student 2 from the preferred community and Student 3 from the minority Hindu Indian community of Springfield were all standing on the side lines of the grounds of Union High School Grounds to play with their Band.  Student 1 had his Saxophone hanging in his neck, Student 2 has his Sticks in his hands and Student 3 has his Saxophone hanging in his neck; they were all standing in a kind of semi circle. They were also surrounded by other students and parents were sitting on the bleachers. All of a sudden Student 2 called the name of Student 1 and said, “there was a special Bus taking Student 1 Home later.” He further said “Right Student 3 (first name)”. The Student 3 said, “Yeah there is” and walked away from there to join his Band and other close friends. Student 3 was on the scene for 2-3 minutes only and Student 1 & 2 are not his friends and he do not socialize with them with Student 1 he has Spanish and with Student 2 he has

The Findings-: According to the investigator Supervisor Plias Student 2 was goofing off when he made the comment to Student 1 that there was a special bus taking Student 1 home later. He realized after speaking with Mr. Plias that what he said was wrong.

Mr. Plias thinks Student 3 being an Hindu Indian is a grown up adult is writing that Student 3 admitted that he went along with the comment because he thought it was “funny and cool”. When he realized that he was bullying, he stopped, moved away, and joined his other friends. All this thinking and serious realization by Student 3 in that 2-3 minutes very brief encounter with Student 1 and 2 how amazing!

In this incident of Oct. 15 the point is not that who is the victim and who are the accused. All of them were 12 yrs old children and they all need to be protected. Mr. Plias is an adult on top of that  protected by top notch attorneys with tax payers money, the victim Student 1 was protected by the complaining adult, his parent made the complaint and other accused Student 2 was protected by Mr. Plias himself because of his religious back ground and may be his father’s clout in the administration. That is the reason Mr. Plias got or may be dictated a very mild statement from Student 2 who started the whole incident that he was“goofing off” when he made the comment to Student 1; he realized after speaking with Mr. Plias that what he said was wrong.

Then why no one thought about protecting the rights of this Hindu Indian Student 3? We all know quote unquote bullying has become a criminal offense and under criminal laws an accused has the right to an attorney and can not be called guilty unless proven guilty beyond reasonable doubt.  Why Mr. Plias never gave him the opportunity of an attorney or his parent. Why Mr. Plias never informed of the incident to the parents before terrorizing, intimidating and racially discriminating the Student 3 to get a statement that he has done bullying.  For Student 3 who is also 12 yrs old Mr. Plias could have got a statement that “after speaking with Mr. Plias he realized adding “Yeah there is” to the wrong comments of Student 2 was wrong on his part.”

But Mr. Plias chose to racially discriminate the Student 3 and terrorized him to expand his original comment “Yeah there is” to include that I stopped when I realize it is bullying along with that I think Student 2 made the comments to be funny and I was also trying to be funny and cool. None of them are original thoughts of Student 3.

One can understand that Mr. Plias/Board’s desire to protect themselves from  potential law suits by the victim Student 1’s parents. In this desire they violated the civil rights and doctrine of racially equality to Student 3 by wrongly accusing him of bullying. Student 3 from minority Hindu Indian community was intimidated, harassed, bullied and terrorized by Mr. Plias to write contrary to what happened. It is a conspiracy to make Student 3 the sacrificial Lamb as a “Party” to be sued on a later date for the so called invented bullying charges by the Student 1’s parent a member of Rulers community of the township.

Every one should condone bullying of all types but still we need to define bullying for comments which are too simple in nature; in writing and must educate all students. We can not leave it on the educators to define bullying on case by case such as what happened on Oct. 15, 2011 as they feel like especially to hurt minority students to save their School Boards from potential law suits by victims or their parents.

We all know lately the society has become very sensitive on the issue of bullying. Even the very learned and experienced academicians and attorneys expert in Education matter can not define the exact definition of a bullying based on verbal comments not related to some one’s ethnicity, color, sexual orientation, physical or mental abilities; when such a statement is a joke and when it is bullying. When adults can not understand it completely how these 12 years old will understand it?

This incident is an eye opener for all of us and we must do some hard thinking on what can happen even with a plain vanilla word“Yeah there is” added by Student 3 to the comment of Student 2 that there was a special Bus taking Student 1 home later.We have to find solutions for this problem especially to give a feeling to the minorities that the lives, racial dignity and liberty of their children are safe in New Jersey Schools. They do have racial equality and they will be treated as equal citizens in their Schools. We need to fine tune the current HIB policy that is not in the best interest of Elementary & Middle School students. Sadly, it does not come as a surprise that it can be used to harass minority students as done by Mr. Plias/Board in the above incident.

It is very serious issue for all minorities living in New Jersey that new HIB policy can be used against their Children. Since Indians are in super minority practically in every town of New Jersey, I appeal to every community organization, activist and every parent to participate in a debate to educate and save our children from being shattered by educators in their schools. At the same time we must approach Governor Christie to get required changes in the current HIB policy especially for Elementary and Middle Schools so that it can not be used against minorities. We must raise the issue that no single religion/ethnic group should be allowed to have more than 45% control/representation of the local government. More then 45% control by one religion/ ethnic group creates anarchy and feudalism not DEMOCRACY. In such situations non members other than the Rulers community can never get any justice like in Springfield where 100% Local government, School Board and important School post are controlled by one religion/ethnic group.

Indian students are protected by true family atmosphere with both parent committed to their marriage and the well being of their children. By nature they are more studious and always try to keep themselves away from troubles especially bullying. It is deeply saddening that Springfield BOE has harassed, intimidated, racially discriminated and wrongly accused a brilliant and quite student from this community simply to save its own skin on the advice of Mr. Plias who is racially biased. Mr. Plias is a threat to the society and he must be dismissed as Supervisor of FMG Middle School.

So once again I appeal to all community organizations and parents to please contact Prof. Saluja             646 247 9458       e-malsalujaindra@gmail.com to appear on his show “Aaj da Mudda Today’s Current Issue” on Juspanjabi TV to make sure your voice must be heard because it concerns the future well being and life of your own children. Besides this we must have more debates at our places of worship on this issue to educate the parents and children.

We all must call our Council Representative, Mayors, Senators, Free Holders, Assembly Representatives, Senators and above all Governor Christie who was most vocal to push the new HIB policy. As a community we must work together to take some actions to protect the interest of our children in New Jersey Schools from possible future harassment, intimidation and bullying by educators from made up bullying charges.

Dear Governor Christie,

I know that you are a very busy man, but I only have two questions for you. Student 2 told Student 1 that he will be going home on a special bus. Then Student 2 said, “Right Student 3 (first name)?” All I said was yeah there is. If what Student 2 said was just wrong comment; then how is my comment bullying? According to my Supervisor Mr. Plias it is and forced me to write that I have done bullying. Why didn’t he ever tell Student 2 that his comment is more than Bullying? I am also very disturbed that Mr. Plias forced me to write that I did this to be funny and cool. The day this incident happened I did not have any time to even think about what happened, how it happened, and what will be the consequences. It never occurred to me that that I said yeah there is to be funny and cool. Why didn’t Mr. Plias make Student 2 write all this, what he forced me to write? He only made Student 2 write that he was goofing off and after talking to Mr. Plias he realized what he said was a wrong comment. Why did Mr. Plias force me to write things which he knew that he is going to use against me only? Was it because I’m not Christian or Jewish and Student 2 is? Is it because of my race, religion and skin color? What Mr. Plias did, crushed the trust between a student and a supervisor. Thank you very much and I hope I can meet you and discuss this incident with you.

Summary of Allegation(s):

Parent of Student 1 alleged that Student 2 and Student 3 were within inches of Student 1’s ear clapping and saying “Hey, Student 1’s name”. Later, when Student 1 asked to go home the same boys told him that he couldn’t go home on the bus with them; he would have to wait for a special bus that would take him home at midnight .

Factual Findings of Anti-Bullying Specialist:

As defined by the new “Anti-Bullying Law”, this incident did escalate to Bullying.

According to Student 2 and Student 3 they are both members of FMG band with Student 1. The FMG band was participating with JDHS band on October 15 th, when the JDHS football team was playing at Union High School . The three boys were participating. Student 2 and Student 3 admitted that they made an inappropriate comment to Student 1 indicating that he would be returning “later” than the other FMG band members. Student 3 admitted that he went along with the comment because he thought it was “funny and cool”. When he realized that he was bullying, he stopped, moved away, and joined his other friends. Student 2 admitted that he was “goofing off” when he made the comment to Student 1; he realized after speaking with Mr. Plias that what he said was wrong.

Disciplinary action was taken for both Students 2 and Student 3 for the comments they made to Student 1 at the football game atUnion High School on Saturday, October 15, 2011 . Mr. Plias has reminded both boys of the importance of being emphatic to others and the harm or hurt that results from inappropriate comments and/or words.

Student 3’s reply to the Board letter of Nov. 08, 2011

After carefully reading the letter from the Board my reply to :

Complaint by Parent of Student 1

  1. “ Parent of Student 1 alleged that Student 2 and Student 3 were within inches of student 1’s ear clapping and saying “hey Student 1’s name” is a lie I never yelled or clapped or said the name of  Student 1. It was Student 2 who called the name of Student 1. More over we were standing in a kind of a semi circle I was on the right side of Student 2 and Student 1 was on his left side. I was holding my Saxophone, Student 2 was holding his Saxophone and Student 1 was holding his Sticks so no one was within inches of any one’s ear. Then we were surrounded by other students also and some parents were sitting on the bleachers.
  1. “Later when Student 1 asked to go home the same boys told him he couldn’t go home on the bus with them; he would have to wait for a special bus that would take him home at midnight .” Again it’s a lie I don’t know about this conversation.  I am hearing this for the first time unnecessarily my name is being dragged for this comment. I am not at all aware if Student 1 and Student 2 had this conversation.

Factual Findings of Anti-Bullying Specialist:

  1. “He would be on a “different/special” bus that would be returning “later” than the other FMG band members” There is an addition of extra words by the Student 1 or may be by his parent or some one else. In my presence the word Different, Returning and FMG band members were not used.
  1. “Student 3 admitted that he went along with the comment because he thought it was funny and cool”. I never admitted to this, the words “funny and cool” Mr. Plias forced me to write on the incident report form on Oct. 19, 2011. I never said these words so the question of my admitting that comment by Student 2 was funny and cool does not arise. The only thing I told Mr. Plias was that it was just a joke by Student 2.
  1. “when he (Student 3) realized he was bullying, he stopped, moved away and joined his other friends”. This is a complete lie. No such realization came to my mind on Oct. 15. There was no time for me to realize any thing after saying “Yeah there is” because I immediately walked away from Student 1 and Student 2 to join my Band.  It was Mr. Plias who told me on Oct. 19 that “Yeah there is” spoken by me is bullying. Till to date I am confused how this is bullying. Mr. Plias told me I have done bullying. He forced me to write in the Incident Report Form that I have done bullying and after realizing I stopped and walked away. It is his own interpretation of my word “Yeah there is” to frame me for bullying. The fact is I left the scene immediately after saying “Yeah there is” to the statement of Student 2 that there was a special Bus taking Student 1 Home later”.

Student 3’s Statement to Mr. Plias on 10-19-11

I was sitting in my class for 8th period when my teacher Mrs. Leonard got a call around 1.40 PM that Mr. Plias wants to see me in his office.   Initially I waited in the office of Mr. Plias. Finally I met him he asked me what happened on Saturday with Student 1 tell me the story. I told Mr. Plias that I was standing with Student 1 and Student 2 on the side lines waiting to go on the field to play. Student 2 called Student 1’s name and said there was a special Bus taking Student 1 home later. Then he said “Right Student 3(my first name)” I said “Yeah there is” and I walked away from them to join my band.

Then Mr. Plais said you know that’s bullying why did you do it?  Then I said it was just a joke by Student 2. Then Mr. Plias said first of all it was bullying and more over when you are joking you are trying to be cool or funny. Then he opened the door and gave me an Incident Report Form and told me go and sit out side and write when it happened, where it happened and what happened. Further Mr. Plias told me that I must include that I stopped when I realize it is bullying and I think Student 2 made the comments to be  funny and I was also trying to be funny and cool.

Under Fear of Mr. Plias I wrote in the Incident Report Form what he told me to write:

I am a member of the Band and so is Student 1 (full name). On Oct. 15 at Union High School for Dayton’s football game Student 2 (full name) said that there was a special Bus taking Student 1(first name only) Home later and I just said yeah there is going on with what Student 2 said. At first I did not realize that this was bullying so when I did I stopped and just left and went to my other friends. I think Student 2 made these comments just to be funny. I went along with it because I thought it would be funny and cool.Mr. Plias or some one else has put quotation mark on the word “cool” I never put those quotation marks on the original Incident Report Form.

Student 1 & 2 are not my close friends, I do not socialize with them at all even on Oct. 15th when this incident happened I stayed with them 2-3 minutes only. With Student 1 I only have Spanish class in common and with Student 2 I have Band & Spanish as common classes.

My mother discussed the incident with me on Oct. 24, 2011 evening after that there was no discussion in the family till Nov. 17, 2011 the day my Father received a letter from the Board falsely accusing me of Bullying. I strongly deny that.
